Does it still need fluffing?

Yes. The hinges swing the branches away from the pole, but step three of the manufacturer's own instructions is to spread the tips by hand. That is normal for a hinged tree at this price.

What happens if a bulb fails?

On many pre-lit trees a single damaged bulb can take out a whole strand. Check the strands before decorating, while the branches are still easy to reach.
